What is the fuel company's responsibility

Fuel companies are required to report all petroleum spills to the DEC even if they do not believe that they are the responsible party. Spills that result from tank overfill, operator error, or spillage before or during delivery are usually considered the responsibility of the fuel company. When an investigation of the spill is conducted, the DEC inspector will make a determination of the cause and source of the spill.

If the fuel company is found to be the responsible party, the company is liable for the cost of the cleanup and the cost of any relocation expenses incurred by the Fund. The fuel company should contact its insurance provider if the company is involved in the spill, whether or not the company believes itself to be responsible.
