Decision Protects Employees Called To Jury Duty
I am pleased that Judge Arcara has agreed that the evidence presented in court supports the need to have new, as well as expanded, buffer zones near reproductive health clinics in Western New York. Our intention in seeking this action is to ensure that law and order is maintained during the "Operation Save America" protests which are scheduled to begin this Sunday.
I believe the Judge's ruling will help achieve this goal. It is important to note that the Judge's order applies to both sides in the debate. It includes reasonable precautionary actions that are designed to ensure access to the clinics while also protecting free speech rights.
I have been in contact with representatives of both sides in this debate, as well as with community leaders throughout the region. We have been working with the law enforcement community to enforce the law and ensure public safety.
I believe that the Judge's decision upholds both Congress' intent that there be access to clinics, as well as the Constitution's First Amendment protection of free speech.
