Statement By Attorney General Eliot Spitzer Regarding The Court's Clean Air Act Decision
Attorney General Spitzer today issued the following statement in response to the U.S. Court of Appeals decision today halting implementation of New Source Review regulations proposed by the Bush Administration. Spitzer's office had crafted the multi-state legal action the court ruled upon today:
"The decision by the DC Circuit Court is one of the most important environmental victories in many years. It will help stop the Bush Administration's ongoing effort to eviscerate the federal Clean Air Act. The administration had attempted to rewrite the statute in a way that would have destroyed it. With this ruling, the Court has held consistent with our view that the new regulation was likely to be found illegal. The importance of this ruling cannot be understated. Not only does it freeze the regulation, but the court has also signaled that it may throw out the entire regulation after further review."
