Statement By Attorney General Eliot Spitzer Regarding Fees Awarded To Public Administrators' Counsel
I applaud today's action by the Administrative Board for the Offices of the Public Administrators in recommending new guidelines and uniform fee schedules for compensation of Public Administrators' counsel in New York City.
These guidelines strike an appropriate balance between recognizing the value of legal services required for small estates and avoiding the accrual of windfall fees to counsel in large estates. The guidelines will also reduce disparities among the fees awarded to public administrators' counsel in the five counties of New York City. These reforms will result in a significant benefit to the public.
I commend Bronx County Surrogate Lee L. Holzman and Westchester County Surrogate Anthony A. Scarpino Jr. for their leadership in proposing the reforms and obtaining board approval. I also want to note the contribution of Kathleen Grimm, Comptroller Carl McCall's representative on the board, and David G. Samuels, my office's representative.
